DMCA Policy

Spotbo, Inc. ("we," "us," or "our") respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act of 1998 (17 U.S.C. § 512) ("DMCA"). This policy describes how copyright holders can report alleged infringement on the Spotbo platform and how affected users can submit a counter-notification.

1. Designated DMCA Agent

2. Filing a DMCA Takedown Notice

If you believe that content on Spotbo infringes your copyright, you may submit a written notification to our designated agent. Under 17 U.S.C. § 512(c)(3), your notice must include all of the following:

  1. A physical or electronic signature of the copyright owner, or a person authorized to act on their behalf.
  2. Identification of the copyrighted work claimed to have been infringed. If multiple works are covered by a single notification, a representative list of such works.
  3. Identification of the material that is claimed to be infringing and that is to be removed or access disabled, and information reasonably sufficient to permit us to locate the material (for example, a direct URL to the content on Spotbo).
  4. Your contact information, including your address, telephone number, and email address.
  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Please send your notice to our designated agent at the contact information listed above. We will review and respond to valid DMCA notices promptly. Upon receipt of a valid notice, we will remove or disable access to the allegedly infringing material and notify the user who posted it.

3. Counter-Notification

If you believe that your content was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notification to our designated agent. Under 17 U.S.C. § 512(g)(3), your counter-notification must include:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access was disabled.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if your address is outside the United States, any judicial district in which Spotbo may be found), and that you will accept service of process from the person who provided the original notification or an agent of such person.

Upon receipt of a valid counter-notification, we will promptly forward it to the party who filed the original takedown notice. If the original complaining party does not file a court action seeking to restrain the user from engaging in the infringing activity within 10 business days, we will restore the removed material.

4. Repeat Infringer Policy

In accordance with the DMCA and other applicable law, Spotbo has adopted a policy of terminating, in appropriate circumstances, the accounts of users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the Service or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

5. Good Faith Requirement

Please be aware that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorneys' fees. If you are not sure whether material on Spotbo infringes your copyright, we recommend consulting with an attorney before filing a notification.
